Cell phone spyware makes it easy for someone to eavesdrop on your conversations, intercept text messages and identify your location. And you may never know it’s happening, experts say.

“You are so dead,” an electronically altered voice taunted Courtney Kuykendall from her cell phone. Courtney’s mother, Heather, told a television station that someone used spyware to terrify her daughter with harassing calls that revealed the caller knew the teenager’s location, what she was wearing and saying.

“This type of issue is almost out of an outlandish sci-fi film. The reality is that there is no question about it, it is happening,” said Robert Siciliano, chief executive officer of Web site IDTheftSecurity.com.

Oklahoma private investigators say they’re getting many requests for listening in on private conversations. But Colin Pressley of Barrington Investigations LLC in Oklahoma City and Larry Mulinix of MPI Agency in Norman said they won’t touch it.

The private investigators said most requests revolve around trying to catch cheating spouses. Other popular requests are from clients who want to ensure their phones contain no spyware.

In most instances, cell phone spyware is illegal, said FBI spokesman Gary Johnson.

The Internet contains numerous ads for cell phone spyware, with software ranging from several hundred dollars to $69.95. Ads contain claims and testimonials such as: “Catch that cheating spouse,” “I learned all I needed to know the very first night,” and “I could not believe what that boy was saying to my 13-year-old.”

Mulinix said some software creates GPS logs of where the target phone has gone. Someone can sit at home and map the phone’s location.

“If I get hold of your phone I can install this, like a SIM chip, open the door up and put this in there, and I can monitor you,” he said. “You won’t even know it.”

The investigators say they stick with legal surveillance techniques.

“You get a lot of people that call up and just want to monitor their wife or spouse. A lot of times I spend hours watching a guy late at night while I’m out there (in the car) drinking Dr Peppers and eating Twinkies,” Mulinix said. “There’s a lot of boredom interrupted by terror.”

Average people can face nearly as much terror from Internet ads that harangue viewers to buy instant downloads. Some boast that, in just minutes, downloaded spyware can begin intercepting text messages and sending text messages notifying the spy every time the target phone makes or receives calls so the spy can listen in on the phone calls.

“Until now, the most bad guys could get are phone lists and the like,” said Sujeet Shenoi, computer science professor at the University of Tulsa, “which would be fine for the National Enquirer getting Paris Hilton’s phone number.”

The celebrity became a victim of cell phone trickery in 2005. T-Mobile and the FBI reportedly launched an investigation after the contents of Hilton’s cell phone appeared online. Numbers and e-mail addresses of celebrity buddies such as Lindsay Lohan and Ashlee Simpson were apparently hacked from her cell phone.

“You’re going to see more people reveal themselves in ugly ways. Right now they’re doing it for fun. They’re doing it for stalking and harassment. And as time goes on, you’re going to see it being used more for financial gain,” Shenoi said.

Courtney Kuykendall, the Tacoma, Wash., resident whose daughter was harassed by someone using spyware, said the calls stopped last summer without police finding a suspect. She said she would like to raise people’s awareness that spyware can be used to terrify.

So you’ve figured out where someone is, but now you want to know what they’re actually doing. Turns out you can listen in, even if they aren’t talking on their phone.

Dozens of programs are available that’ll turn any cell phone into a high-tech, long-range listening device. And the scariest part? They run virtually undetectable to the average eye.

Take, for example, Flexispy. After a little more explanation, their answer as to the legality ofthe service ends with a broad statement: “Please consult a qualified lawyer in your country for the correct answer to this question.”

Let me make it easier for you: Once you get into listening in to private conversations without either party’s consent, you’re treading rough water that could sweep you straight into jail. Whether it’s an employee or a spouse on the receiving end of your mission, neither federal nor state privacy laws take violations lightly in America. Getting caught could cost you several years behind bars, among other serious penalties.

Detecting and protecting

Finding spyware on your phone isn’t easy. There are dozens of bug detectors available from surveillance companies, but the only true fix is taking your phone to your provider and having them wipe it out altogether. That will restore the factory settings and clear out any hidden software that’s running on your phone.

Security experts say there may be some subtle signs your phone is invaded:

* You seem to have trouble shutting it off, or it stays lit up after you’ve powered down.
* The phone sometimes lights up when you aren’t making or receiving a call, or using any other function.
* You regularly hear odd background noises or clicks when you’re on the phone.

Unfortunately, there isn’t much you can do to safeguard your cell just yet. I’m sure it’s only a matter of time until we see McAfee-style programs to firewall your phone and keep intruders out. Retina-X’s “Mobile Nanny,” the software that allows parents to control their child’s mobile device, the software allows parents to filter out activities within their child’s cell that they don’t want to occur, including the increasingly popular “sexting,” the act of sending and receiving sexually explicit text message through a mobile device.

“For many parents, giving their child a cell phone becomes a dilemma due to the abuse of the privilege,” James Johns, CEO of Retina-X Studios, said. “Mobile Nanny gives the edge back to parents so they can make sure their kids are staying on the right track.”

With the Mobile Nanny, specific phone numbers can be blocked from texting and call communication, as well as restrictions on Web sites and applications. And, as a way to enforce a “cell phone curfew,” parents can restrict use of the device to specific times, and prohibit use at other times, such as school hours or late in the evening.

And, since the software runs silently in the background as soon as the phone turns on, parents can access the interface by clicking an icon and entering a password. The entire monitoring system can be fully hidden if a parent chooses to monitor their child’s behavior in a covert manner.

When messages and calls are received, the program silently uploads logs to the parent’s private account, which they check online without needing access to the phone.

For parents who request even more detail, complete text messages, call histories and GPS logs are viewable to parents online or inside an interface on the device itself.

So, for parents worried about their teens activities, this new software system allows fears to be eased, and safety to be reinforced.
